DMCA Policy

MaxxCity Realty LLC (“MaxxCity Realty,” “we,” “us”) respects the intellectual property rights of others and expects users of our websites to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), the text of which is codified at 17 U.S.C. § 512, we will respond expeditiously to claims of copyright infringement on websites owned or operated by MaxxCity Realty that are reported to our designated copyright agent.
1. Designated Copyright Agent
If you believe that material accessible on or from any MaxxCity Realty website infringes your copyright, you may request removal of that material (or access to it) by submitting a written notification to our designated agent:

2. What to Include in a Notification
To be effective under the DMCA, your notification of claimed infringement must be a written communication that includes substantially the following (see 17 U.S.C. § 512(c)(3)):
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the full URL of the page where the material appears).
- Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an email address at which the complaining party may be contacted.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
3. Our Response
Upon receipt of a notification that substantially complies with the requirements above, MaxxCity Realty will act expeditiously to investigate the claim and, where appropriate, remove or disable access to the material identified as infringing.
We may also forward the notification to the user or third party who provided the material and may terminate, in appropriate circumstances, the accounts of users or visitors who are repeat infringers.
4. Counter-Notification
If you believe that material you posted to a MaxxCity Realty website was removed or disabled by mistake or misidentification, you may submit a counter-notification to our designated agent pursuant to 17 U.S.C. § 512(g). Your counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which MaxxCity Realty may be found, and that you will accept service of process from the person who provided notification of the alleged infringement or an agent of that person.
5. False Claims
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages.
6. Modifications
MaxxCity Realty may modify this DMCA Policy at any time. The then-current version will be posted on this page with the effective date above. Continued use of any MaxxCity Realty website after a change to this policy constitutes acceptance of the revised policy.
